CORDELE — Judge Sarah Wall has continued a hearing concerning Antwoine Yowe’s contention that the results of the Nov. 3 city election and Dec. 1 runoff should be voided.
Attorneys for Yowe and the city of Cordele met in judge’s chambers with Judge Wall Thursday morning, and a new hearing date of Jan. 26 has been set.
Judge Wall who is a superior court judge in the Oconee Circuit has been appointed to handle any issues arising from Cordele’s 2009 election results.
On behalf of Yowe, Albany attorney Maurice King argued in a public hearing Thursday that 2009 election results are invalid because voting changes made by the city since 1986 have not been pre-cleared by the U. S. Justice Department.
Specifically, King said any voter who has been annexed into the city since 1986 is not a legal voter.
City of Cordele Attorney Tommy Cotton said two pieces of property, one in the southeast quadrant and another in the southwest quadrant of the city have been annexed.
He said all the paperwork requesting pre-clearance has been submitted to the Justice Department, but it has not been approved.
